FACULTY ACTIVITIES

Dean William Powers delivered the George S. Heyer Jr. Distinguished Lecture at the Austin Presbyterian Theological Seminary on Apr. 30, 2003. His lecture, entitled “Our Fractured Understanding of the World,” drew comparisons between law and theology.

Mitchell Berman presented a paper on “Constitutional Decision Rules” at faculty workshops at Northwestern University on Apr. 9, 2003, and the University of Chicago on Apr. 17, 2003. Berman attended the First Annual Constitutional Theory Conference, held at Vanderbilt University, Apr. 11-12, 2003, where he commented on a paper by Seana Shiffrin.

Philip Bobbitt’s The Shield of Achilles: War, Peace, and the Course of History (2002) won the grand prize in the 2003 Robert W. Hamilton Book Awards, presented annually by the University Co-op to honor outstanding books authored by University of Texas faculty.

Jack Getman was one of 50 distinguished international business and labor leaders and scholars invited to speak at a conference entitled “The Future of Organized Labor: Restoring the Balance in a Time of Growing Inequality,” sponsored by UT’s LBJ School of Public Affairs, and held Apr. 22-24, 2003, in Washington, D.C.

Henry Hu appeared on the National Public Radio show, “Marketplace Morning Edition,” on Mar. 5, 2003, discussing corporate governance and other issues relating to shareholder annual meetings. In March 2003, comments that Warren Buffett reportedly made about gold during a visit to Hu’s class several years ago were noted by analysts and media reports in speculation as to the current Berkshire Hathaway investment portfolio. These included reports in Africa News, Mar. 4, 2003, Australian Financial Review, Mar. 6, 2003, and CBS MarketWatch, Mar. 4, 2003. Hu was quoted in the Houston Chronicle, Feb. 21, 2003, on settlement matters involving Merrill Lynch and the Securities and Exchange Commission relating to certain Enron-related transactions. Hu was quoted in the Los Angeles Times, Feb. 20, 2003, with respect to a massive consolidated class action relating to the initial public offering activities of 55 investment banks and 309 companies. Hu discussed the Financial Accounting Standards Board in relation to pension accounting in the Dallas Morning News, Feb. 19, 2003. Hu was quoted by Bloomberg News, Feb. 13, 2003, on issues relating to Ford Motor CEO William Clay Ford’s purchase of shares in the Goldman Sachs IPO. Hu was quoted in the Wall Street Journal, Feb. 5, 2003, on poison pills and staggered boards in a story on SEC Chairman William Donaldson’s past role as Aetna’s CEO. Hu was quoted in the Wall Street Journal, Jan. 31, 2003 and Wall Street Journal Europe, Jan. 31, 2003, on possible sanctions in “failure to supervise” cases in a story on Frank Quattrone, a former star investment banker at Credit Suisse First Boston.

Neil Netanel presented his paper, “Impose a Noncommercial Use Levy to Allow Free P2P File Sharing,” before the Stanford Law School faculty colloquium on Apr. 9, 2003, and at Fordham Law School’s 11th Annual Conference on International Intellectual Property Law and Policy on Apr. 25, 2003. At the Fordham conference, Netanel also spoke on panels on “The United States Supreme Court and Intellectual Property Law” and “The Courts, Copyright, and the Constitution.”

Ronald Mann gave a talk on “Legal Issues About Electronic Money” on Apr. 29, 2003, at the Center for Research on Electronic Commerce in UT’s Red McCombs School of Business.

Richard Markovits was the discussant for a session entitled “What is Control Fraud?” at a policy conference on “Corporate Governance and Control Fraud,” sponsored by the LBJ School of Public Affairs, Apr. 28, 2003, at UT’s Thompson Conference Center.

Steven Ratner was quoted in the National Law Journal, Mar. 31, 2003, on the possibilities for trying Iraqi leaders for war crimes. Ratner gave a talk on Apr. 17, 2003, at the University of California Boalt Hall School of Law Workshop on International Law, entitled “Precommitment Theory as a Framework for Self-Restraint by States: Explanation and Examples.”

Jay Westbrook was quoted in the Wall Street Journal, Apr. 30, 2003, on the rising number of foreign corporations that seek bankruptcy protection in U.S. courts.
